Terms of Service

Please read these Terms of Service carefully before applying to or using Spark Twice. By submitting an application or engaging with our service, you agree to be bound by these terms. If you do not agree, please do not proceed.

1. About Spark Twice

Spark Twice is a curated matchmaking service operating across the United States at sparktwice.com. We facilitate introductions between compatible adults seeking meaningful long-term relationships. The service is operated by Spark Logic LLC, a United States limited liability company. References to "Spark Twice," "we," "us," or "our" throughout these Terms refer to Spark Twice and its operator, Spark Logic LLC.

2. Eligibility

To apply to and use Spark Twice, you must:

• Be at least 18 years of age at the time of application
• Be legally single: not currently married, not in a domestic partnership, and not in an exclusive relationship with another person
• Be genuinely seeking a serious, long-term romantic relationship
• Provide truthful, accurate, and complete information throughout the application process
• Reside in, or be willing to meet with compatible introductions in, a geographic area where Spark Twice is actively operating within the United States

Spark Twice reserves the right to decline any application at our sole discretion, without obligation to provide a reason.

3. Application and Membership

Application Process

Submitting an application does not guarantee membership. Each application is reviewed individually by our team. We evaluate compatibility, sincerity of intent, and fit with our current member community before extending an invitation to join.

Membership Acceptance

If your application is accepted, you will be contacted by our team to discuss next steps, expectations, and the terms of your engagement with the service. Membership is personal and non-transferable.

Active Participation

As a member, you are expected to respond to outreach from our team within a reasonable time, engage in good faith with introductions offered, and communicate honestly with both our team and anyone you are introduced to.

4. Your Responsibilities

Accuracy of Information

You agree to provide accurate, current, and complete information at all times. Misrepresentation of your identity, relationship status, intentions, or any material fact is grounds for immediate removal from the service without refund.

Respectful Conduct

You agree to treat all Spark Twice staff and introduced members with dignity and respect. Harassment, manipulation, threats, or any form of abusive conduct toward staff or members will result in immediate termination of membership.

Safety and Honesty in Introductions

When meeting someone through Spark Twice, you agree to exercise reasonable personal safety precautions, meet in public places initially, and to never misrepresent your identity or intentions to the person you are introduced to.

Prohibited Uses

You may not use Spark Twice for any of the following purposes:

• Soliciting business, promoting products or services, or any commercial purpose
• Seeking relationships that are not genuine or long-term in nature
• Collecting personal information about other members for any purpose
• Any activity that violates applicable local, state, federal, or international law

Zero Tolerance for Objectionable Content and Abusive Behaviour

Spark Twice has zero tolerance for objectionable content and abusive users. By using Spark Twice you agree not to post, send, or share any content, and not to engage in any behaviour, that is unlawful, harassing, threatening, abusive, hateful, defamatory, sexually explicit, or that depicts or promotes violence, exploitation, or the abuse of any person. You agree not to impersonate anyone, solicit money, or attempt to defraud, endanger, or exploit another person.

You can report objectionable content or another member at any time — from their profile, from within a message thread, or by emailing support@sparktwice.com — and you can block another member so they can no longer contact you. We review every report and will act on reports of objectionable content or abusive behaviour within 24 hours, which may include removing the content and ejecting the user who provided it. This complements our Content Policy and Community Guidelines, which are incorporated into these Terms by reference. Violating this section is grounds for immediate removal from the service without refund.

5. Our Role and Limitations

What We Do

Spark Twice acts as an introduction service. We research, curate, and facilitate introductions between members we believe may be compatible. We may use automated tools to help surface potentially compatible members, but every introduction is reviewed and made by a real person on our team; no introduction is sent to you automatically.

What We Cannot Guarantee

We cannot and do not guarantee that you will find a romantic partner, that any introduction will result in a relationship, or that any information provided by other members is accurate. We make every reasonable effort to verify members but cannot guarantee the conduct or character of any individual.

No Liability for Member Conduct

Spark Twice is not responsible for the actions, conduct, or statements of any member before, during, or after introductions. Any in-person meetings or ongoing communication between introduced members occur at your own risk and discretion.

6. Confidentiality

All information shared between members in the context of an introduction is considered private and confidential. You agree not to share another member's personal information, including their name, contact details, photographs, or anything they have told you, with any third party without their explicit consent.

Spark Twice similarly commits to protecting your confidential information in accordance with our Privacy Policy.

7. Fees and Payments

Active membership is offered on two plans, Classic and Premier, each of which you can pay for on a monthly or a 3-month (quarterly) cycle:

• Classic — $57 per month, or $153 every 3 months
• Premier — $97 per month, or $261 every 3 months

Fees are charged on a recurring basis through EasyPayDirect, our third-party payment processor. Your membership begins on the date of your first payment and renews automatically at the end of each billing cycle you chose — every month, or every 3 months — at the then-current rate, unless cancelled. There is no annual plan, and there are no unlock, introduction, setup, or success fees; the subscription is the only charge.

You may cancel your membership at any time by contacting us. Cancellation takes effect at the end of the current billing period. You will retain access until then. We do not issue refunds for partial billing periods, except where required by applicable law.

Spark Twice reserves the right to adjust its fees at any time. Active members will be notified by email at least 14 days before any price change takes effect. Continued use of the service after the effective date constitutes acceptance of the new fee.

Referral Program

Members may invite others to apply using a personal referral link. A person who applies through your link receives priority review of their application. It does not guarantee acceptance, which remains at our sole discretion under the same standards applied to every applicant.

If a person you referred is accepted and becomes a paying member, you earn one free month of your membership, applied as account credit toward a future billing period. A referrer may earn at most one free month within any rolling twelve (12) month period, regardless of how many people they refer. The reward is earned only once the referred person's paid membership becomes active; it has no cash value, is not transferable, and cannot be exchanged for a refund.

Self-referrals, referrals of existing or former members, and referrals we determine to be fraudulent, automated, or abusive are not eligible. Spark Twice may modify, suspend, or discontinue the referral program, or revoke a reward obtained in violation of these terms, at any time.

8. Termination

By You

You may withdraw your application or cancel your membership at any time by contacting us. If you are a member, you can also delete your account and personal data directly in the app at any time: open Settings in your member dashboard and choose Delete my account. Upon cancellation or deletion, your data will be handled in accordance with our Privacy Policy.

By Spark Twice

We reserve the right to suspend or terminate your application or membership at any time, with or without cause, including but not limited to: misrepresentation, violations of these Terms, conduct we deem inconsistent with the values and safety of our community, or if we determine that a suitable match is not available for you at this time.

9. Intellectual Property

All content, branding, design, and materials on the Spark Twice website and associated materials are the property of Spark Twice and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

10. Disclaimers

The Spark Twice service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or that introductions will result in any particular outcome.

To the fullest extent permitted by law, Spark Twice disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Spark Twice and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of opportunity, emotional harm, or any damages arising from interactions with other members, whether or not we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to your use of the service shall not exceed the total fees you have paid to Spark Twice in the six months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Spark Twice and its operators from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your interaction with any other member.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of Spark Twice shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration or the jurisdiction of courts as mutually agreed upon by the parties.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated to active members by email. Your continued use of the service following any changes constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

16. Additional Terms for Our Mobile App (Apple App Store)

These additional terms apply when you download or use the Spark Twice application from the Apple App Store. They form part of the end-user licence agreement (EULA) between you and Spark Logic LLC.

• This agreement is concluded between you and Spark Logic LLC only, and not with Apple Inc. ("Apple"). Spark Logic LLC, not Apple, is solely responsible for the app and its content.
• Apple has no obligation to furnish any maintenance or support services for the app. Apple is not responsible for addressing any claims you or a third party have relating to the app, including product-liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer-protection or privacy law.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the app's purchase price to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
• Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms of agreement (for example, your wireless data-service agreement) when using the app, and with the Apple Media Services Terms and the App Store Usage Rules.
• Subscriptions to Spark Twice are sold and billed by Spark Logic LLC through our own payment processor via a purchase completed outside the app; they are not Apple in-app purchases, and Apple is not a party to them.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Spark Twice regarding your use of the service, and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
